Acceptance of These Terms

Using the MotorBenz website means accepting the conditions set out on this page. Anyone who does not accept them should stop using the site. These terms apply to every visitor, whether or not an account has been opened.

Eligibility

Use of the site is limited to individuals aged eighteen or older who are residents of the United States and legally able to enter into a binding agreement. Submitting a form confirms that both conditions are met.

Nature of the Information Provided

Everything published here is general information about auto insurance concepts, coverage parts and the choices that shape a premium. It is not a policy, not an offer of insurance and not a guarantee that any particular coverage will be available or priced in a given way.

A binding policy exists only once an insurance carrier issues it, and the carrier document controls in every case where its wording differs from anything described on this site.

Accounts and Credentials

An account holder is responsible for keeping login details private and for all activity carried out under those credentials. Suspected unauthorised use should be reported without delay so access can be secured.

Accounts may be suspended or closed where these terms are breached or where activity suggests fraud or misuse.

Accuracy of Submitted Details

Quotes and coverage suggestions depend entirely on the details supplied. Incomplete or inaccurate information about a vehicle, a driver or a claim history can lead to figures that do not hold once verified, and in some cases to a carrier declining or adjusting cover.

Acceptable Use

• Do not submit false, misleading or another person's details without authority
• Do not attempt to gain access to systems, accounts or data belonging to others
• Do not interfere with the operation, security or availability of the site
• Do not use automated tools to harvest content or submit forms
• Do not reproduce or republish site content for commercial purposes
• Do not use the site for any unlawful or fraudulent purpose

Intellectual Property

The text, layout, graphics and structure of this site are owned or licensed and are protected by applicable law. Personal, non commercial viewing is permitted. Copying, redistribution or adaptation without written permission is not.

Links to carriers, tools or reference material are offered for convenience. Outside sites are not controlled from here and no responsibility is accepted for their content, accuracy, security or practices.

SMS Messaging Program Terms

Program name: MotorBenz Auto Insurance Text Messaging Program, operated by MotorBenz, 3633 Inland Empire Blvd, Ontario, CA 91764.

Program description: MotorBenz sends two kinds of text messages, each with its own separate opt-in on the account signup form. Service messages include quote confirmations, policy and renewal reminders, coverage update alerts and replies to questions you send us. Marketing messages include MotorBenz auto policy offers, renewal discounts and coverage add-on promotions. Consent to either message type is optional and is not a condition of opening an account, requesting a quote or purchasing a policy.

Message frequency: Message frequency varies. Service messages are sent in response to your quote, policy or account activity. Marketing messages are sent up to 4 times per month.

Message and data rates may apply. Check with your mobile carrier for details of your messaging plan.

Opting out: Reply STOP to any MotorBenz text message to cancel. You will receive one final message confirming that you have been unsubscribed, and no further messages will be sent unless you opt in again.

Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.

Privacy: Your mobile number and SMS opt-in consent will not be shared with third parties or affiliates for marketing or promotional purposes. How your information is collected and used is described in the Privacy Policy.

Supported carriers: Messages are supported on major U.S. carriers including AT&T, T-Mobile, Verizon and their affiliated networks. Availability may vary by carrier.

Disclaimer of Warranties

Limitation of Liability

Arbitration Agreement

Any dispute connected with the site or these terms is to be resolved by binding individual arbitration rather than in court, except that either side may bring a qualifying matter in small claims court.

Arbitration proceeds on an individual basis only. Class actions, class arbitrations and representative proceedings are waived by both sides. The arbitrator decides the dispute and the award may be entered as a judgment in any court of competent jurisdiction. Anyone who prefers not to arbitrate may opt out by sending written notice to the address listed below within thirty days of first accepting these terms.

Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Subject to the arbitration section above, the courts of that state have jurisdiction over any remaining matter.

Severability and Waiver

If a provision is found unenforceable, the rest of these terms remain in force and the provision is applied as far as the law allows. A delay in enforcing a right does not waive it.

Changes to These Terms

These terms may be updated as services or legal requirements change. The effective date at the top of the page shows when the current version took effect, and continued use after a revision indicates acceptance of it.
